A man and his daughter have filed a $10 million lawsuit claiming Auburn University is wrongly charging in-state students with more expensive out-of-state tuition.

The Opelika-Auburn News reports the suit was filed by Jeffrey Prosser and his daughter Brooke Prosser. They say they live in the east Alabama city of Valley but previously lived in Georgia.

In-state tuition for Auburn undergraduates is $5,746 per semester, while out-of-state tuition is $15,562. Brooke Prosser claims she qualifies in-state tuition, but Auburn is instead charging out-of-state tuition.

Her father says university officials have refused appeals. The man says other families are having the same problem.

Auburn declined comment, saying it can’t talk about pending litigation. School officials haven’t filed any response to the lawsuit, which was filed last week.
